Social Security Disability

If earn more than SGA then automatically not disable. The SSA sets each year a total amount that you can earn monthly and if you earn more than that amount, then you are not disable. 

Your medical condition(s) must be severe enough to impact your ability to work.

If your medical condition meets a SSA listing criteria than you are disabled. If it does not, then you proceed to step 4.  At this step, the SSA divides your body into several segments and tests your medical condition against a qualifying segment.  For example, but not complete, sight, hearing, heart, musculoskeletal, mental, etc.   

If you can perform your past work in your current medical condition than you are not disable. If you do not meet these criteria, then you proceed to step 5.

At this step, the SSA determines if you can perform other work with your medical condition.  If SSA finds that you can perform other work, then you are disabled.

There are several steps in process.

The final step is in Federal Court.

–You can restart the process after the hearing is unfavorable or after the council denies your benefit claims.
